Social Workers Compensation
Classification of Social Workers for the Purpose of Workers’ Compensation
The National Council on Compensation Insurance (NCCI) confirmed an initial change in the classification of hospice employees for the purpose of workers’ compensation that took effect on October 1, 2005. Before this change, social case workers were classified as outside salespersons under Code 8742; the 2005 change ensured that SWs would be classified under Code 8835 for consistency among hospice employees. Code 8835 provides higher workers’ compensation rates for social workers, now classified in the same category as professionals who provide medical and home health care.
The difference in workers’ compensation rates will vary among states, so it is important that hospice leadership contact the state insurance administrative organizations provided for more information.
Code 8835 does not apply to California, New York, or Texas, and has not applied in these states since its initial implementation in 2005. Social workers in California fall under Code 8827-2—PUBLIC HEALTH NURSING ASSOCIATIONS—ALL EMPLOYEES. All social workers traveling to a different facility or a patient’s home to provide services fall under New York Code 8857. In Texas, social workers in the hospice industry fall under Code 8828—HOME HEALTH CARE—ALL OTHER EMPLOYEES.
Massachusetts, New Jersey, Oregon, and Virginia are listed as state exceptions to the code as of its latest revision, in February of 2007. Each state exception contains language that varies from the national code.
In MA, NJ and OR, Code 8835 requires that social workers in the industry are classified under Code 8742—SALESPERSONS. The variation in VA Code 8835 does not relate to social workers; SWs in the hospice industry in VA fall under the national Code 8835.
All states with the exception of CA, NY, TX, MA, NJ and OR must use Code 8835 to classify SWs providing care for hospice patients. The following state insurance administrative organizations will be able to provide additional information regarding rates specific to each state.
